He is a regular speaker at events around the globe and is frequently cited in the media for his knowledge on criminal issues, enforcement matters, compliance and corporate governance. Mike is licensed in Virginia and the District of Columbia.

Bill Hauserman, Senior Director, Compliance Solutions, Bureau van Dijk, a Moody Analytics Company: Bill joined Bureau van Dijk in 2016 after 12 years designing global compliance and ethics programs for SAI Global and NAVEX Global. On May 2, 2019, the Treasury Department’s Office of Foreign Asset Control (“OFAC”) issued its promised guidance for sanctions compliance programs (“SCP”) (Here). 

OFAC “strongly encourage[d]” companies subject to OFAC jurisdiction to implement a “risk- based approach to sanctions compliance by developing, implementing and routinely updating a SCP.”

The Anti-Money Laundering Act of 2020 (AMLA) was enacted on Jan. 2, 2020, when Congress overrode President Donald Trump’s veto of the National Defense Authorization Act. The AMLA is the most significant revision of U.S. anti-money laws since the USA PATRIOT Act in 2001. The AMLA: (1) expanded the Treasury Department’s whistleblower program; (2) authorized FinCEN to establish a beneficial ownership registration database targeting shell companies; and (3) created new Bank Secrecy Act (BSA) violations and enhanced BSA penalties for repeat and egregious violators.

With the continuing impact of COVID-19 and economic disruptions, the Justice Department and the SEC continued to push FCPA enforcement. DOJ and the SEC repeated broad statements confirming continued aggressive enforcement programs. However, DOJ and SEC’s record revealed a slow down in corporate enforcement actions.

The new Administration continues to push anti-corruption initiatives, including the release of its Strategy to Counter Corruption, and has promised a more aggressive approach to white collar crime enforcement, including the FCPA. Deputy Attorney General Lisa Monaco previewed this new enforcement push and specifically mentioned that more corporate compliance monitors will be imposed in the future. Despite the uneven record, FCPA criminal enforcement against individuals continued at a steady pace and portends even more cases in 2022. 

With the growing use and reliance on economic sanctions as a policy lever, the Justice Department and the Office of Foreign Asset Control continued their aggressive enforcement of economic sanctions. OFAC and DOJ joined together in the SAP sanctions enforcement case, which established significant new requirements for sanctions compliance programs. OFAC continues to raise compliance expectations, hold individual and corporate actors accountable, and pointing to specific lessons learned.   

In this two-part webinar (January 5 and January 12, 2022), Michael Volkov will review 2021 FCPA and Sanctions enforcement and compliance trends.
